Warshauer Woodward Atkins Attorneys Secure $3.2 Million Dollar Verdict in Wrongful Death Trial

On Tuesday, August 22, 2017, a Cobb County, Georgia jury returned a verdict of $3.2 million dollars against a local hospital and a physician group for the wrongful death of our client’s wife while she was a patient at the local hospital. Warshauer Woodward Atkins partner. As with all Warshauer Woodward Atkins cases, it was a team effort as Lyle Warshauer provided critical assistance in strategy and legal issues throughout the trial.

Our client’s wife was treated at the hospital following a motor vehicle collision for an ankle fracture, broken ribs and abdominal contusions. After spending one day in ICU, she was transferred to a surgical floor where she was receiving morphine via a pain pump and Lortab (both opioid pain medications). The third day in the hospital, a physician added another opioid, Oxycontin. Our client’s wife, suffered respiratory depression, a known risk of opioid pain medications, and ultimately suffered respiratory and cardiac arrest resulting in an anoxic brain injury. She died three months later. While she was on the hospital floor, she was not being monitored by continuous pulse oximetry or by any other means.
