21st Century Cures Act and Dangerous Drugs & Devices Marketed to Women

May 24, 2022

In December 2016, the United States Congress passed the 21st Century Cures Act, which greatly undermines the health and safety of women across the country. This act debilitates patient safety by rolling back regulations requiring pharmaceutical companies prove drugs and medical devices are safe and effective. Without the use of clinical trials, these drugs and devices can now be marketed with FDA approval, which is far easier to get than it should be.

Mother cradling newborn. The 21st Century Cures Act endangers women and children by removing testing requirements of new drugs and devices.

According to the American Association for Justice, women are more exposed to unsafe drugs and medical devices than men. This disproportionate and shocking statistic refers specifically to vaginal health, including birth control, tampons, and other toiletries. Falsely marketed as safe, these drugs and medical devices have led to countless reports of illness and even death. Despite the corporations and government being alerted to these dangerous statistics, these products continue to stay on shelves and have even increased their marketing.

Marketed even to those as young as their early teens, these huge risks pose a critical threat to women across the world, and this is a disturbing reality the legislation has seemingly ignored. Knowingly selling a product which may very likely cause severe illness and death is an inherently immoral act, one which many people refuse to stand for.

What Can I Do?

Some of those very people who refuse to stand for these horrific and unbelievable acts are those willing to take on these selfish pharmaceutical and medical device manufacturers and corporations to hold them accountable. By remaining vigilant, refusing to take no for an answer, and publicly exposing them, we can help fight against these shameful and appalling realities. The American civil justice system is our only hope to improve safety standards when all else fails–we can affect change by forcing recalls, enhancing warnings, and thus saving lives.
