Two Killed in Gwinnett County Crash

Mar 5, 2015

A crash involving two vehicles on Rockbridge Road near Walnut Creek in Lilburn killed two people early Sunday, February 22, 2015. Apparently a 19-year-old driver crossed the center line and drove into oncoming traffic, causing a head-on collision. Both of the drivers died at the scene. A full investigation is still pending.

It is unclear at this point why the driver crossed the center line, but the fact remains that he did. The estate of the other driver could bring a wrongful death case against the young driver’s estate for expenses related to damage to the vehicle and for funeral expenses. A wrongful death case is never limited because the other person involved in the accident also passed away. The person’s assets still “live on” in their estate.

Often, for young drivers, the only way that they have any assets in their estate is if their insurance company pays for costs related to the accident. Assuming that he was covered by insurance at the time of the accident, the insurance company will generally still cover any damages caused by the driver, even if the driver has now passed.
